A notice should include:

  1. a sufficiently substantiated explanation of why the content is considered illegal,
  2. the exact electronic location, in particular the complete URL, file or path details and, where necessary, further information enabling identification,
  3. the name and email address of the notifying person or entity, unless a legally recognised exception applies,
  4. a statement confirming that the information is accurate and complete to the best of the notifying party’s knowledge.

Incomplete notices may result in follow-up questions or delays.

3. Acknowledgement and Review

If the notice contains electronic contact details, PRESTA.hosting will acknowledge receipt without undue delay. Notices are reviewed in a timely, diligent, objective, non-arbitrary and proportionate manner. The urgency, nature of the alleged illegality, risks to persons and systems, and available evidence will be taken into account.

4. Possible Measures

Depending on the circumstances, PRESTA.hosting may in particular:

  • request further information,
  • hear the affected customer where legally and practically possible,
  • temporarily secure or restrict content or access,
  • disable access to specific content,
  • partially or fully suspend affected services,
  • reject notices where there is no sufficient basis,
  • involve authorities, courts or law-enforcement bodies where necessary.

As a rule, the least restrictive suitable and legally permissible measure will be selected. No general monitoring without specific cause takes place.

5. Decision and Statement of Reasons

The notifying party will be informed without undue delay of the decision and any available redress options. Affected users or customers will receive a clear and specific statement of reasons for restrictions unless a statutory exception, a risk to investigations or another compelling reason prevents this.

6. Abuse and Confidentiality

Manifestly abusive, automated or repeatedly unfounded notices may be appropriately restricted. Personal data and identities will be disclosed only to the extent necessary and legally permissible. Notices are documented for evidentiary, security and legal-defence purposes.
